General Terms and Conditions of Sale and Use

E-VALUES - The innovative recruitment testing platform

ARTICLE 1 - Scope

These General Terms and Conditions of Sale (GTCS) apply to all service provisions concluded with Sigmund Distribution, which operates the E-values.eu website (hereinafter referred to as the SERVICE PROVIDER), located at 22 rue des Malassis 94400 Vitry-sur-Seine, via its website, and concerning the following services: use of testing software.

ARTICLE 2 - Orders

Only transactions carried out via the website are taken into account. The CLIENT selects the services or tests they wish to order on the site. They provide the required data to create a customer account and subsequently access it, accept the general terms and conditions of sale, and confirm payment.

ARTICLE 3 - Prices

The services and software offered on the site are provided at the rates and conditions in effect on the day of the order and as mentioned in the catalog. These rates are net and displayed excluding tax.

ARTICLE 4 - Payment Terms

Service provisions are payable in full when the order is placed, as specified in Article 3, through a secure electronic payment system accessible from the site (credit card, PayPal, etc.) or manually (check, bank transfer, etc.).

ARTICLE 5 - Terms of Service Provision

The services requested by the CLIENT are provided upon receipt of payment for the order. This period is not a strict deadline, and the SERVICE PROVIDER shall not be held liable to the CLIENT for any delay in the provision of services not exceeding 15 days.

ARTICLE 6 - Intellectual Property Rights

The SIGMUND site is subject to French legislation on copyright and intellectual property, law of July 1, 1998 (Article L112-3). The general design, as well as the texts, animated or still images, sounds, know-how, and all other elements composing the site, are the exclusive property of the SERVICE PROVIDER.

ARTICLE 7 - Use of Services and Software Compliance

The CLIENT acknowledges having the competence to access the SIGMUND site, being able to use it, and having verified that the computer configuration they use does not contain any viruses and is in perfect working order.

ARTICLE 8 - Data Protection

Sigmund Distribution creates a file containing information about its clients. The collection of this information allows for managing customer accounts and producing invoices. The CLIENT gives their express consent to the creation of this file containing all information related to their use of the site and purchased services.

ARTICLE 9 - Liability

These GTCS concerning the use of the SERVICE PROVIDER's software by the CLIENT on the website, the SERVICE PROVIDER's liability under these terms shall not be sought in case of hardware malfunctions.

ARTICLE 10 - Software Assistance and Maintenance

Assistance with the use of the SERVICE PROVIDER's software is provided exclusively via the website in the form of a Frequently Asked Questions (FAQ). In some cases, if the CLIENT deems it useful to resolve difficulties more quickly and efficiently, excluding hardware failure, they may contact the SERVICE PROVIDER using the contact information provided on the website.

ARTICLE 11 - Disputes

All disputes to which this contract may give rise, concerning both its validity, interpretation, execution, termination, consequences, and aftermath, shall be submitted to the Paris courts.

ARTICLE 12 - Contract Language - Applicable Law

By express agreement between the parties, these General Terms and Conditions of Sale and the purchase and sale operations resulting from them are governed by French law.

ARTICLE 13 - CLIENT Acceptance

These General Terms and Conditions of Sale are expressly agreed and accepted by the CLIENT, who declares and acknowledges having perfect knowledge of them, and therefore waives the right to invoke any contradictory document, particularly their own general terms of purchase, which shall be unenforceable against the SERVICE PROVIDER, even if they have been made aware of them.
